The Hazardous Waste Combustion Emission Standards Rule requires use of particulate matter CEMS but then says that the requirement is deferred pending future rulemaking? Are they required or not?

The installation of particulate matter CEMS is not required in this final rulemaking. The Agency is committed to requiring the use of CEMS for compliance assurance. Although we have nearly completed successful demonstrations of particulate matter CEMS, additional information is needed prior to requiring installation and use of these units as compliance measuring devices. The rule says that particulate matter CEMS are required but then defers all substantive requirements (i.e., the requirement to purchase, install, correlate, maintain, and use for compliance with the standard is deferred). EPA intends to require CEMS in a future rulemaking.
