At what point must a determination be made regarding whether a potentially recyclable material is a solid waste?

The solid waste determination for recycled material is made at the point of generation and must take into account how the material is recycled throughout the entire recycling process.  Memo, Lowrance to Bates; October 11, 1991, (RCRA Online #11644).
