We are designing a new municipal solid waste landfill and recently heard that the Ford Act made the distance between a landfill and an airport increase to six miles. Is this true?

On April 5, 2000, Congress signed into law the Aviation Investment and Reform Act for the 21st Century (Ford Act), which prohibits the location of new MSWLFs within six miles of airports served by specific aircraft.  EPA published a direct final rule to add a new MSWLF location criterion in Section 258.10(e) to reflect the Ford Act.  EPA withdrew this direct final rule due to adverse comments.  EPA published a technical amendment to the MSWLF criteria to add a note about location requirements enacted in the Ford Act.  EPA clarified that the note in Section 258.10 is for advisory purpose only and the specific limitations of the Ford Act are not being incorporated into the MSWLF criteria
